In response, Brian Berry, Executive Director of the Ticket Policy Forum, released the following statement:&nbsp;<\/p>\n\n\n\n<p>\u201cThis terribly flawed proposal&nbsp;will reduce access to tickets for popular events on reliable platforms that come with guarantees and protections, fuel&nbsp;fraud and scams on social media sites, and empower Ticketmaster and box offices to increase prices without any oversight. Make&nbsp;no mistake: under this proposal, ticket prices will continue to rise and scams will increase. It\u2019s no surprise Ticketmaster, whose executives bragged about \u2018gouging\u2019 fans and \u2018robbing them blind,\u2019 supports these policies. If Ticketmaster is for price caps, any politician who cares about their constituents must oppose them.&#8221;<\/p>\n\n\n\n<p>Concerns with the proposal include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Glaring loophole for Ticketmaster.<\/strong>\u00a0The proposal only applies to reselling tickets. That\u00a0means primary sellers like Ticketmaster are exempt, allowing them to raise prices and use dynamic pricing\u00a0unchecked \u2014 all of this for a company whose <a href=\"https:\/\/urldefense.proofpoint.com\/v2\/url?u=https-3A__www.nytimes.com_2026_03_12_arts_music_live-2Dnation-2Dticketmaster-2Dtrial-2Dfees-2Dslacks.html&amp;d=DwMGaQ&amp;c=euGZstcaTDllvimEN8b7jXrwqOf-v5A_CdpgnVfiiMM&amp;r=M1BPoKHC65NFXJLuc64UmfOVySybMp8CDT2bNCaPKE8cRs4JIwawWRFg276wFYZY&amp;m=1qoEvjk71I0u-g8SIB_7aErEbdf4ow180Ztdj-rFXRx3JXecYGkCI7aHBquU9q49&amp;s=AwOrxOkHdq3t70TQGhE5u0on0B92ry3vqU8NhsTQCao&amp;e=\">executives<\/a>\u00a0said they \u201calmost feel bad\u201d about \u201cgouging\u201d fans and \u201crobbing them blind.\u201d\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Drives transactions underground.<\/strong>\u00a0Price caps push sellers off regulated marketplaces and onto social media and informal channels, which have no consumer\u00a0protections and law enforcement has no visibility. Independent\u00a0studies show ticket <a href=\"https:\/\/urldefense.proofpoint.com\/v2\/url?u=https-3A__bradshawadvisory.com_insights_ticket-2Dfraud-2Dits-2Dimpact-2Dand-2Dthe-2Dcost-2Dof-2Dmarket-2Dregulationnbsp&amp;d=DwMGaQ&amp;c=euGZstcaTDllvimEN8b7jXrwqOf-v5A_CdpgnVfiiMM&amp;r=M1BPoKHC65NFXJLuc64UmfOVySybMp8CDT2bNCaPKE8cRs4JIwawWRFg276wFYZY&amp;m=1qoEvjk71I0u-g8SIB_7aErEbdf4ow180Ztdj-rFXRx3JXecYGkCI7aHBquU9q49&amp;s=aR33-_83iGO5v1D3UNLO0FFNG_vh9seuHW5HykYo4Q4&amp;e=\">fraud is 4x higher<\/a>\u00a0in areas with price caps.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Unenforceable by design.<\/strong>\u00a0The policy provides no mechanism to compel Ticketmaster or box offices to share the original purchase price of a ticket\u00a0with resale platforms. Without that data, marketplaces have no reliable way to determine what a seller paid \u2014 making it\u00a0impossible to enforce these price caps.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Built on a false premise.<\/strong>\u00a0Legislating around high-demand outlier events \u2014 like World Series games or Taylor Swift concerts \u2014 is poor public policy. The overwhelming majority of events do not sell out, and consumers already have abundant options at accessible prices through both primary and secondary markets.
